Section 106 of the National Historic Preservation Act of 1966 requires federal agencies to consider impacts to historic properties when making project decisions. It requires the identification of sites greater than 50 years of age, which are then evaluated for eligibility according to guidelines established by the National Register of Historic Places (NRHP). Effects to eligible sites from the project are then determined. If a project results in an Adverse Effect, KYTC will work with the State Historic Preservation Office (SHPO), the lead federal agency, and consulting parties, if applicable, to determine appropriate ways to avoid, minimize, or mitigate the impact. Although, KYTC is a state agency, many projects are funded at least partially by the Federal Highway Administration (FHWA). Even state-funded projects may require permits from the U.S. Army Corps of Engineers. Involvement of a federal agency in a KYTC project necessitates Section 106 review. Architectural Historians in the Cultural Historic Branch devote much of their time to historic bridge evaluations. As bridges age, the need for repairs or replacements arise. Metal truss bridges are increasingly rare on Kentucky roads and many of them are eligible for the NRHP. If the bridge project results in an Adverse Effect, mitigation measures including State Level I Documentation and marketing are generally acceptable to FHWA and the SHPO. Truss bridges slated for replacement are marketed to the public for relocation per federal guidelines. Interested parties must submit a proposal to the district highway office which is then reviewed for appropriateness. If approved, the new owner must consent to a maintenance agreement. The bridge will be match-marked and disassembled and the individual or group taking the bridge will receive funds, not to exceed the cost of demolition, to defray the costs of reconstructing the bridge.
