The Ecology and Permitting Branch assures that KYTC maintains compliance with the Clean Water Act and the Endangered Species Act. The Branch obtains several types of Clean Water Act permits/approvals including Section 404 permits from the United States Army Corps of Engineers, Section 401 Water Quality Certifications from the Kentucky Division of Water, and Individual Kentucky Pollutant Discharge Elimination System (KPDES) permits from the Kentucky Division of Water for construction impacts not covered under the General KPDES permit for Construction Activities. The Branch is also responsible for coordinating with the US Fish and Wildlife Service regarding Endangered Species. Consultation is required to assure that proposed highway projects will not have an adverse effect on federally listed threatened and endangered species.
