DBE Final Rule Update

Where are we now?​
The Kentucky Transportation Cabinet (KYTC) has completed the required DBE/ACDBE re-evaluation process under 49 CFR Part 26.111 and 23.81. 

Are DBE Applications Open?
Yes. KYTC is accepting New DBE/ACDBE Applications and Interstate applications. New applicants must complete the current application process and meet all requirements of 49 CFR Part 26.
 
What if my firm did not submit re-evaluation documents?

​Previously certified Kentucky firms that have not ​submitted​ the required Personal Narrative and Personal Net Worth Statement may still submit the required documentation. Unless KYTC has provided your firm with a different deadline, non-responsive firms have until March 24, 2027, to submit the required documentation.  

What happens if my firm has been Re-Evaluated?
If your firm has successfully completed the re-evaluation process with KYTC, your firm will be listed on the KYTC DBE Directory. However, the KYTC will not establish DBE contract goals until KYTC received the necessary approvals.

What about Out of State firms?
Interstate firms previously certified in Kentucky that have been reevaluated by its Jurisdiction of Original Certification (JOC) do not need to reapply. The firm may provide its JOC’s decision letter or proof from the JOC’s directory showing that it was reevaluated and retained. The firm must supply this letter or proof within one year of the date it was reevaluated by its JOC.

When will DBE goals resume?
Project specific DBE goals will resume once the applicable Federal Requirements have been satisfied and KYTC receives the necessary approvals.
