Beginning with July 2008 Letting
Guidance for the Use of Uniformed Law Enforcement Officers in Highway Work Zones In conjunction with the regulations set forth as part of SAFETEA-LU Subpart K to 23 CFR part 630, attached is the "Guidance for the use of Uniformed Law Enforcement Officers in Highway Work Zones". As can be seen from the guidance document, KYTC's project teams should address the use of Uniformed Law Enforcement Officers in highway Work zones as a component of the Traffic Management Plan (TMP) prepared for each project. Please begin to address this item in the TMP no later than the July 2008 project letting.

In the Revision, new classes have been created for the Crash Cushion Type VI and VII. The two new classes for these crash cushions are Class B and Class C.

Standard Specifications for Road and Bridge Construction Edition of 2008

Standard Drawings Revision No. 1 to Reprint No. 9

The Kentucky Department of Highways intends to publish the new Standard Specifications for Road and Bridge Construction Edition of 2008 and Standard Drawings Revision No. 1 to Reprint No. 9. These documents will be effective with all applicable projects let for construction on January 1, 2008 and thereafter.

This memorandum is being issued to advise of an update to Design Memorandum 6-99. This Design Memorandum 6A-99 supersedes Design Memorandum 6-99 for all design activities performed by District Design and Consultant Engineer personnel.

Beginning with March Letting
Supplemental Electronic Project Files

The main request of the KAHC Grading Committee was that the contractors be allowed access to all available electronic project files before the letting. Previously the "Supplemental Pre-Bid" information was made available for use during the bid process, and "Supplemental Post-Bid" information was given only to the awarded contractor.

Beginning with the March 2007 letting, all supplemental electronic project files will be made available to the contractors before the letting. The contractors will have to sign a disclaimer before they get the electronic data. The Department is making these files available to contractors and assumes no responsibility for their accuracy.

Omni-Directional Breakaway Support System for Type 1 Posts Supporting multi-post Sheeting Signs located within the clear zone.
Design memorandum No.14B-04 states that all projects let to contract after July 1. 2006 shall utilize omni-directional breakaway sign supports, for all installations of large multi-post signs located within the clear zone, and not protected by crashworthy barriers. to implement this new Highway Design policy, an entry, for "Type D Breakaway Sign Support Systems for Type 1 Post" has been added to the outline of "Approved Materials' maintained by the Division of Materials.

Effective January Letting
ADA Compliance on Sidewalk, Curb Ramps, and Driveway Access
Three Standard Drawings (ERPM150, ERPM152, & ERPM170) have been modified to strengthen their compliance with the Federal Americans with Disabilities Act (ADA) and Americans with Disabilities Act Accessibility Guidelines for Buildings and Facilities (ADAAG). Sidewalks, curb ramps, and driveway access shall be designed, constructed, operated and maintained so that all pedestrians, including people with disabilities, can travel safely and independently.

Electronic Drainage Folder Submittal Requirements
Effective January 1, 2007, the policy of this Cabinet shall be to require the submittal of dramage information in electronic format in accordance with PDF (Portable Document Format) standards. The PDF file format has been proven to be a universal format in the preparation of project documents that are distributed via the internet or other media and as a format that lends itself well for project archival. All future drainage folder submittals shall be in PDF.

Right-of-Way Monumentation

After July 1, 2005, any project that has not submitted right of way plans shall establish and monument the right-of- way boundaries for the newly acquired right-of-way boundaries. We will not permanently monument existing right-of-way . Monumentation shall be placed in accordance with the Standard Drawings and the Special Note for Right-of-Way Monuments (See attached). Monumentation includes right of way monuments, right-of-way witness monuments, and witness posts. The intent is to define the right of way boundaries on our plans and in the field.

Waste Sites

Senate Bill No. 211 which was passed during the last legislative session amended KRS 176.050 to require designers to identify potential waste sites "for a city, county, or other governmental entity to turn into an industrial park upon completion of the road project…." Sites must be "at least four (4) acres in size, along the proposed new route. The Department shall consult with the appropriate elected officials to identify waste sites along the proposed new route that may be potential industrial park sites."

Environmental Checklists

Effective immediately, environmental checklists will no longer be required to be attached to the inspection reports. Checklists will now be required to be submitted with Right-of-Way Plans and Final Plans submission on federally funded projects. The checklist will be mailed directly to the Director, Division of Environmental Analysis in both cases. Copies of the checklist will be sent to the Central Office Location Engineer and the Central Office Programming Staff. A copy will also be sent to the Director, Division of Right-of-Way with the Right-of-Way Plan submittal. Desirably the checklist should be sent 30 days prior to the actual Right-of-Way Plan submittal to allow review time in advance of the actual demand for the federal funding.

Empower Kentucky Directions

All projects shall be scoped at least one year prior to the authorization of project design. The scoping will be utilized to address project issues including purpose and need, termini, deficient conditions to be addressed, refined cost estimates by phase, identification of critical environmental issues or any special issues or concerns, and an expected fiscal year schedule for the major phases. This activity will be required for all projects beginning with FY 2000 design. The form for scoping is attached and is meant to replace Exhibit 03-03 in the Design Manual. When completed, copies of this form is to be submitted to Central Office Design and Programming. The Statewide Preliminary Design Consultant may be utilized for these scoping efforts if requested by the District Preconstruction Engineer.

Design Exceptions for Vertical Clearance on Interstates

Effective immediately, it will be necessary to coordinate all design exceptions for vertical clearances on the interstate with the Military Traffic Management Command Transportation Engineering Agency. A clearance of 4.9 meters over the entire roadway width, including the useable width of shoulders, will be required on all rural interstate routes. The 4.9 meter clearance will also be required for the urban interstate routes identified on the attached maps. 4.3 meter clearance will be required on other urban interstates not designated on the maps.

Transmittal of Right-of-Way and Utility Plans and Right-of –Way and Utility Plan Revisions

The Designer is now responsible for providing all required copies directly to the Division of Right-of-Way and Utilities regardless of whether the final roadway plans are currently in the District or already submitted to Central Office. If the roadway plans have already been submitted to Central Office, the Designer will also be responsible for providing corrected sheets for the final plans or assuring that the corrections are made on those plans.

Engineering Agreements/Contract Modifications

When a change order is requested, the consultant shall be responsible for providing a brief explanation (desirably less than one page) for the need for the change order. The explanation must be written such that someone not familiar with the project may understand the purpose of the request. It must make clear why the requested work was not covered with the original agreement or in previous change orders. It must also address whether the currently contracted dates are to be affected by the change and if so, new projected dates of completion must be provided. This information is to be provided to the Project Manager who will endorse it to the Director, Division of Professional Services. Timely responses to all requests for change orders are to be given.

Pipe Cover Height Tables

The new Cover Height Tables represent a significant change in how the Department deals with selecting pipe alternates, how pipe quantities are summarized, and how pipes are represented on pipe sheets. Attached, please find these new pipe Cover Height Tables which will be effective with the September, 1996 letting. Standard Drawings RDI-001, RDI-020, RDI-030 shall become void as of the effective date. Standard Drawing RDI-025 shall remain active.

Upon completion of the response by the Project Engineers, copies of the report shall be sent to all involved persons; i.e. - discussion of environmental shall be sent to Environmental Analyses. In all instances, copies shall be sent to the consultant and to the Director, Division of Design. The Consultant Monthly Report shall be submitted starting in August, 1995.

This memorandum shall become void when superseded or its contents are placed in the appropriate design manual.

Environmental Procedures on State Funded Projects

As soon as possible following project auithorization, the potential project impact area should be investigated by the Project Engineer to determine the possible presence of wetlands, cultural resources, or other environmental concerns,. If any issues of environmental concern are identified, an immediate request for investigation should be submitted to: Director, Division of Environmental Analysis (Mail Code A-1) along with the project information noted in Table 1 below.
